The items listed below reflect the terms and conditions applicable to the Gabriana Jewelers showroom and online stores. All information, products and services available from this site to you, the user, are conditioned upon acceptance of all terms, conditions, policies and notices stated here.
By visiting our showroom or site and/ or making purchases, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein. These Terms of Service apply to all customers, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read all sections carefully before proceeding. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is limited to these Terms of Service.
Any new features which are added shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Section 1: Store Policy
EXCHANGES: Items may be exchanged within 15 days of purchase. Merchandise must be in original and unworn condition and accompanied by an original receipt and original gift box. Special orders, altered pieces (including ring sizing) ,and custom pieces are not returnable or exchangeable. Gift Certificates are not redeemable for cash and may be used for purchases only. Exchange will be given in the form of a STORE CREDIT OR EXCHANGE ONLY.
SPECIAL ORDERS & CUSTOM WORK: All special orders require a 50% deposit and are non-cancellable. Special orders are not refundable or exchangeable. A special order includes any jewelry, gemstone or watch that has to be ordered to accommodate the client’s request for an alternative style, size, metal or color that is not available in stock. Custom designed jewelry involves metals, gems, and labor furnished for a specific client. Custom jewelry is non-refundable and requires a 50% non-refundable deposit before the work begins. Every effort will be made to accurately manufacture or produce the item(s) so ordered. Full payment upon receipt of custom work will denote the client’s complete satisfaction.
LAYAWAY POLICY: Layaway payments are required at least every 30 days. Articles placed on layaway will be held for a period of 90 days from the date on this receipt. If no satisfactory arrangements have been made for full payment beyond the end of this period, the item(s) will be returned to stock, and all payments will be forfeited. At our discretion only, layaways may be canceled in the event of special circumstances. In such a case a restocking fee of 15% of the original invoice will be charged , with the remaining balance to be issues as a store credit only.
LIMITED GUARANTEE: Your Gabriana Jewelers item is guaranteed to be free from manufacturer defects for the full lifetime of the item. Should your item develop a problem due to carelessness, an accident ,or deliberate misuse, Gabriana Jewelers will repair it at a modest cost & will determine the cause of the defect.
REPAIR TAKE IN: Liability for any damage or lost of items shall be limited to actual cost to repair or replace the item(s). Gabriana Jewelers
shall not be held responsible for the following : identification or condition of jewelry at time of receipt ; altered , treated, or enhanced diamonds or colored stones; and/or pieces that are unmarked or marked incorrectly .Not responsible for items left beyond 90 days.
SERVICE AND CLEANING: Gabriana Jewelers will clean your jewelry (ultrasonic or steam) and check the settings free of charge. We recommend this be done every 6 months .Not responsible for the loss of stones due to worn prongs and settings when cleaning.
WATCH REPAIR GUARANTEE: There is no guarantee for moisture , bands ,crystals. Replacement of watch battery does not guarantee function or water resistance. Battery life is not guaranteed.
COLORED GEMSTONE ENHANCEMENT DISCLOSURE: Purchasers of colored gemstones should be aware that natural gemstones are processed from the time they are extracted from the earth by one or more traditionally accepted trade practices. All relevant information will be provided to the best of our knowledge. Prevailing market values are based on these universally practiced and accepted processes by the gem and jewelry trade.
Section 2: Online Store Policy
By agreeing to these Terms of Service, you may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.
Section 3: Etsy Store Policy
If you're not satisfied with your purchase, notify us within 3 days of receiving your order then proceed to ship the return back within 7 days from the delivery date. Please contact us before shipping the item(s). Please note that buyers are responsible for return shipping costs.
Custom made or personalized items are non-refundable. Please consider cancellation within 24hours of placing a custom made order. Any cancellation after the time will incur a corresponding processing fee of 10% of the item amount.
Layaway items are non-refundable and do not qualify for additional discounts. A 20% deposit is required to place an item on layaway and the buyer is obligated to track payment progress. Orders will be shipped after paid in full. Any purchases made through our layaway program are final.
Cancellations made be requested within 1 hour of purchase.
Section 4: General Terms
Gabriana Jewelers reserves the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
Section 5: Warranty Disclaimer
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Gabriana Jewelers, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

If, at our request, you send certain specific submissions or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation to maintain any comments in confidence, to pay compensation for any comments; or to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website.
